Labor Code Section 132a Claims and Serious & Willful Violations

With recent changes in workers' compensation laws, and with the decrease in permanent disability benefits, we expect a significant increase in petitions alleging violations of Labor Code Section 132a and employer's Serious and Willful violations. These return to work issues are now a bigger potential minefield than ever before. With the increase of DFEH litigation, these claims are also much more complex to defend. It is imperative that employers have an attorney experienced with these overlapping issues to defend their interests.
